'i' For Israel or 'i' For Islam..You choose.

Bismillahirahmanirrahim. In the name of Allah, the Beneficent, the Merciful.

Alright, lest get straight to the point. All of us had face this kind of situation.

"dude, you wearing that ? It is a symbol of satan"

"then, should I take it off ?"

"of course."

OR

"you know what, I just read about the laptop that you just bought it yesterday, it is actually one of the Israel's conspiracy"

"Where did you read about it?"

"somewhere on the Internet"

Yeah. It is undeniable that nowadays most of us will take any of the news or trust 100 percents from the hearsay. Don't lie. That's our mentality today. Not all of us. but most of us. In a mean time, I'm not saying that we shouldn't trust it at all. What I'm trying to say is, take some time, do some research and think rationally.



It's like.."owh, that laptop..if I use it, its like I am cooperating with satan ? Ok, I'm gonna throw it out."

It's funny 'cuz every time you put your mindset towards all the hearsay, you are going to throw all of your stuff ? Think rationally, you use that laptop for what? For your convenience. For your own good.

Lately, some of you might received the messages about iPhone in which it said that 'i' stands for Israel. Again, take some time, do some research and think rationally and don't just rely only on one source. Sometimes, it's all depends on yourself. Either to look at it as 'i' for Israel or 'i' for Islam.

After all, always put your faith towards Allah. Let your life guided by the holy Quran and As-Sunnah, and live your life in Islamic way.

World's Biggest Crisis!


If you go and do some research on the internet, you would probably won't find any terms of 'war' as one of the biggest problem or crisis in the world. Trust me, I dare you to do so and what you could find is all about education, water, poverty and etc. In my points of view, there are two reasons for this;

1. Education, water and etc problem is actually killing more people than what is so called as 'war'. Tsunami killed over a millions of people in 2006 and recently in japan, it killed over hundred of thousands of people.

"what about education?". Well, an estimated of 101 million children are not in school in which more than half of them are girls. I know, at the end of the day, all of these girls will end up being either a part time or a full time chef at home. :P
Just kidding. Ok, lets get back to business, actually they are being denied for their basic human rights to education. Its hard to survive without education in our modern day right now.

"well, how about water? 70 percents of the earth are covered by water, so?". You've got a point there, but did they have not need to pay for the bills ?

"Because of that?" Of course not, what i mean is clean water. More than one out of six people have lack access to safe drinking water. 1.8 million people die every year from diarrhoel disease and 3900 children die every single day from water borne disease.

2. Because the terms 'war' is actually (for me) referred to the terms 'conflict' rather than refer it to the terms 'crisis'.

"If you say so, then what the hell with your title of your entry?"

Before I make my conclusion and gives you my answer, lets warm our brain up. To be a critical thinkers, one must not find the answer straight away, yet he or she should look for the reasons and application. Then you will understand the whole theory. Lets start with our world international issue in which it is correlated with the terms 'war'.

Yesterday, western forces hits targets along the Libyan coast by using strikes from the sea and from the air in order to force Muammar Gaddafi's troops to cease fire and end attacks on civilians. Later, an hour later in which by this morning on 20th of March 2011, United States of America and Britain warships and submarines 110 Tomahawk missiles against air defences around the capital Tripoli.

They attacks Libyan in order to stop that country from killing the Libyans' civilians, ironically, they also causes 48 of the civilians killed and another 150 injured. These leaders from USA, Britain, France, Canada and Italy had reached the consensus to take a military actions upon Libya after the claim that Gaddafi broke his pledge of a ceasefire overnight. This operation is called Operation Odyssey Dawn. This is parallel to enforced the United Nation's resolution.

This resolution was made to save the civilians (but at the same time causes a death and injury to them) and to counter attack this, Muammar Gaddafi said that he will use his civilians.

"now need to open all the buildings and provide the people with guns, with all kinds of weapons, to defend the independence, unity and dignity of Libya" ~ Quoted Muammar Gaddafi in his speech a few hours after the attack.

If you really think deeply about this particular thing, it is actually pertaining to something which we called as "Humanity Crisis". Yup, this war conflict is indirectly related to the "humanity crisis, lack of understanding". This can be said as the biggest crisis and problem right now. It is a field broad scope, humanity involving in our daily life, humanity in executing or enforcing a law and so on. But in this entry, I narrow it down into this particular terms...

Make me understand better


Hey reader..

In this entry, I would like to talk about the techniques that you will use when you are in the middle of a discussion, or a debate or giving an advice to someone else or even when you are trying to persuade someone to believe in you. First of all, some of you might question to me what is the purpose of this entry actually. It is actually pertaining to what I faced during my final examination. Indirectly this could be a good lesson for me when ever my friends put their question upon me.

Here's the situation..

me: If you don't mind, could you please tell me a little a bit about the course that you've been taking right now.

Mr. A: Sure. First of all, we need to know did the course that I've been taking right now is legally in the eyes of law ? Yes, since Legal Profession Qualifying Board has been recognize this course in which LPQB is also recognize and establish by the Legal Profession Act under section 4 and 5 bla bla bla...

Can you see it. I'm asking this particular guy to tell, not to clarify or explain from the root point about this course. So, it is much more easier and better if this guy gives the simplest answer, yet it gives the whole pictures which regards to it. Ever heard about the Occam's Razor Theory ?

Occam's Razor Theory states that, in giving a theories, the simpler theory is to be preferred. Why ? For a better understanding. A doctor are not going to explain about the process and causes in your stomach. In contrast, he's just going to say that you are experience a food poisoning. That's it. So lesson number one, give a simplest ideas or example when I or who ever it is asking for consultation.

"But what if he or she is stupid enough to understand my simplest analogy? "

Stupid enough ? Then make them much more stupid. :)

Just Kidding, use the concept proposed by Harry Truman. "If you cannot convince them, confuse them"

" Don't you think that this concept is actually supporting your statement about make them much more stupid? " (-_-ll)

Did I ? hehe.. :P

So, lesson number two, do not and never ever use this concept proposed by Harry Truman when involving a situations like this. I mean, when it is regards to an educational matters. NEVER!
I remember when my schoolmate told me that his chemistry teacher said that "what a long answer, but I don't even know what is he trying to say". 5 science 1 and 5 science 2 have two different chemistry teachers. So, is this guy was trying to confuse his teacher in order to convince him ?
Second situation that this concept is not going to works is in a consumers-sellers-dealing stuff. Take a shot to look at ebay or mudah or etc statistics. A lot of stuff, minimal percentage of dealing matters. It is called "paradox of choice".

But, this concept might be works on a certain things especially when it is involving a political and economical matters. ^^

"Then ? The next solution iiissss..?"

If he still did not understand, ask him to go and look for another person.

What the hell..?


Gosh! It is totally freaking me out and totally weird !

"Why ?" Because recently I've been dreaming and thinking about the same person over and over and over again in my head.

"Huh! What is so weird about that ? " Because I never talk to that person and I am really seldom to see her. Obviously, she's not my classmate and so yeah, it's weird. o.O

But never mind, maybe I'm just envy with her since she got higher marks than me in test. And out of the blue, I am eager to know about her..and out of the blue again, I just get to know that her pointer for the previous semester is juuussssttt below me. :O

"First of all ?? work hard la..haizz..do I have to remind you every time dude ? " *sigh*
"secondly, errr...(one hour later..because I do really left my lappy, this entry for one hour).."

End of Semester 2

Bismillahirahmanirrahim..in the name of Allah, the Beneficent, the Merciful..

Now, the moment when I post this entry was exactly at 11.00pm on 15th of March 2011. Today is the last day of examination and by tomorrow I'll be going home. My parents will come and may we will have a safe journey. Amin.

so, yeah..I've done my best in my examination. Frankly speaking, the subjects on this semester is much more easier than the previous semester. As compared to before, we have to memorize and understand every single concept and doctrines of law proposed by the philosophers of law. Not to forget that I do really really really damn wanted to have my lucky 4 for this semester. 4 flat for my final exam and band 4 for my MUET. insyaAllah.. ^^

However, I felt a little bit disappointed with my carry marks on a certain subjects. Actually on the subject of Introduction to Law 2 only. It is not on my expectation. Alhamdulillah, thanks to Allah, I'm still have my momentum on my study. It's just that, there's a slight decreased on my carry marks of MTC037 (Intro To Law 2) beacause of my assignments. Not going to babbling on that, all I wanted to say is "find your best partners for your third and most important semester". Define "best partners" .

It can be defined as follows;
1. He or she are going to put 200 percents COMMITMENT on assignment
2. He or she knows how to COOPERATE to complete the assignment given ('cuz I hate chicken)
3. He or she are NOT GOING TO POSTPONE the works (really hate this habit)
4. He or she knows how to CONTRIBUTE MONEY on this assignment
5. He or she knows how to carry out a research. Every time have to consult ! *sigh* (-_-ll)

and other criteria(s) that is relevant.

Some might think that I am very cocky and act like a perfect person who never have any of these bad habit, yeah..i do have, but not every time and every single second. thank you.

p.s: and I don't like people who only knows how to copy and 'renovate' on someone else's assignments. Maybe you should reconsider back to continue your study if this is your attitude.

Enough with the lessons I learnt for my second semester. ^^

Oh yeah, not to forget, I'll try my best to upload and tell a litle bit about my activities on my second semester.

i greet u all with Islamic greeting of peace..assalamualikum wbt.

i've been thinking about this..i mean, i expect this to happen, in which i'm not going to up date or post any new entry on my blog when my second semester began. plus, that is what i've done in the past..i created this blog 2 weeks before my registration day for my first semester, and all that moment goes by without any new entry up till i finished my first semester. sigh..

i started to think that i don't deserved to have this blog..i have so many things in my head that i wanted to throw it out and paraphrase it into my damn blog..politics, law, friends, activities while in campus, test, assignments and so on. yet, it's all end up with nothing. but..nevermind.

i will have that moment since my second semester will be end for another 1 week. it's all about final exam before it ends.

Resolution 62/149

Resolution 62/149 - Moratorium on the use of death penalty. This resolution was proposed by the United Nations in order to abolish all of the use of death penalty. It means, no more death penalty for every type of criminal offense.

In the moratorium, it states about five important agendas, as such as;

1. Expresses its deep concern about the continued application of the death penalty;

2. Calls upon all States that still maintain the death penalty to:

(a) Respect international standards that provide safeguards guaranteeing the protection of the rights of those facing the death penalty, in particular the minimum standards, as set out in the annex to Economic and Social Council resolution 1984/50 of 25 May 1984;

(b) Provide the Secretary-General with information relating to the use of capital punishment and the observance of the safeguards guaranteeing the protection of the rights of those facing the death penalty;

(c) Progressively restrict the use of the death penalty and reduce the number of offences for which it may be imposed;

(d) Establish a moratorium on executions with a view to abolishing the death penalty;

3. Calls upon States which have abolished the death penalty not to reintroduce it;

4. Requests the Secretary-General to report to the General Assembly at its sixty-third session on the implementation of the present resolution;

5. Decides to continue consideration of the matter at its sixty-third session under the same agenda item


Actually in December 18th, 2007, UN human rights council has proposed a resolution 62/149 concerning the moratorium on the death penalty which has been enforced by the UN in the countries that still practice death punishment, including Malaysia, which also has been asked to abolish the use of the death penalty.

In my past entry about the bribery crime, i did mention about my support towards the death penalty for the bribery case. Yet, the United Nations has been proposed to abolish the death penalty. However, we have to remember that, Article 6 of the International Covenant on Civil and Political Rights UN made it clear that the right to life, including repeal the death penalty. Unfortunately, Malaysia does not sign this convention.

If Malaysia truly is an Islamic country, then we should have enforced 'hudud', 'qisas' and etc. Again in my past entry, i already mention about al-qisas (the law of equality in punishment).

Liberation of The Stiver of Democracy

This new entry is solely is about Aung San Suu Kyi, the striver of democracy for Burma. As you know that on 13th of November 2010, she was released after almost 15 years out of 21 years from 1990. Frankly say that, release as a prisoner in her own home.

Who is Aung San Suu Kyi ?

Aung San Suu Kyi is a daughter of late Aung San, former of commander of the Burma Independence Army, and late Daw Khin Kyi, former senior nurse of Rangoon General Hospital. She is also a former National League for Democracy party and a achiever of a;

1. Rafto Human Right Prize in October 12th, 1990
2. Sakharov Prize for Freedom of Thought by European Parliament
3. Peace Price by Norwegian Nobel Committee in October 14th, 1991
4. Jawaharlal Nehru Award for International Understanding by the Government of India
5. International Simon Bolivar Prize by the Government of Venezuela

How did she been placed under house arrest ?

In September 24th, 1988, National League for Democracy was formed with Aung San Suu Kyi was the general-secretary. Their policy is non-violence and civil disobedience. Suu Kyi makes speech-making tour throughout country to large audiences in defying ban of more than four persons by the State Law and Order Restoration Council (SLORC). SLORC was established by the military in September 18th, 1988.

Since that Suu Kyi was still continuing her campaign from January until July, despite harassment, arrests and killings by soldiers, Suu Kyi was prohibited from the election in February 17th, 1989. April 5th, 1989 was the climax towards her detention in her own home where Suu Kyi courageously walks toward rifles soldiers which aiming at her and by July 20th of the same year, she was placed under house arrest, without charge or trial. At November 13th , 2010, she was released.

Happy Deepavali !




Actually in this entry I won't discuss about any kinds of law or politics, especially about the by-election at Batu Sapi and Galas..hehe ^^

I just want to tell about yesterday. Well, actually I'm not so prefer to type about my activity or about my routine, but ever since that there's still connection with law so I take a shot to tell about it.

so, what I did yesterday ?

~ National Library at 10 am
~ Objective: to discuss about MUET
~ Gave a shot to Hakim to have his breakfast first before discuss about MUET
~ After zohor, went to Jaya Jusco
~ Objective: to find reference books for second semester
~ Well, not even a single book that we found
~ Went to Times Square, Borders
~ At lower ground, damn small since Borders at 3rd floor is having their renovation
~ Keep searching..it does took us some time.
~ Found two out of four books
~ Drop by at KFC
~ Cybercafe for one hour
~ Went back to home.

By the way..Happy Deepavali to all of my fellow Indians friends and respected teachers.

The Law of Equality In Punishment

Today, (october 3oth 2010), i read a newspaper about Datuk Sosilawati's case where her eldest daughter, Erni Dekritawati Yuliana Buhari (Rita) filed a claim worth RM40 million at High Court towards N Pathmanabhan and his friends.

This entry is not to discuss about this case, but to discuss about Rita's action.

"Tujuan kami hanya satu, bagi memastikan keadilan dapat ditegakkan sepenuhnya",
"Our goal is only one, to ensure that justice can be fully enforced". Quoted Rita.

She also hopes that people would not misunderstood with her actions.

For me, yes, people should not misunderstood, and so do they have to know in order to understand.

Why did I agree (actually, partial agree with this)? Simple, it is because of the same reason, 'justice'.
"please clarify more.."

First and foremost, ever heard the word of 'Qisas' ?

"O you who believe! Al-Qisas (the Law of Equality in punishment) is prescribed for you in case of murder: the free for the free, the slave for the slave, and the female for the female. But if the killer is forgiven by the brother (or the relatives, etc.) of the killed against blood money, then adhering to it with fairness and payment of the blood money, to the heir should be made in fairness. This is an alleviation and a mercy from your Lord. So after this whoever transgresses the limits (i.e. kills the killer after taking the blood money), he shall have a painful torment."
(Al-Baqarah: 178)

Did the murderers were sentenced to death ? no! only 7 years due to lack of evidences. What will you do if you're in her (Rita) shoes ? What is her situation now and onwards ? That is why i bold an important sentence there.

Secondly, readers might questioned to me that all of the murderers is an indian. So let me summarize their positions in this country (Malaysia). In this case, they have been categorized under "Kafir Dzimmi". Who is "kafir dzimmi" ? That is those who is not a muslim, which having a peace treaty with Islamic state. Moreover, they are also residing in the Islamic state and submit to Islamic rule. They are the citizens of Islamic state and the laws of Islam is apply to them except a few things excluded in syara'. They have the same rights as the rights of Muslim citizens and property of others Islamic state, blood and honor they are awake.

Islamic law is not the law of individuality, but the most universal law and it applies to all of us, and of course it applies to all of the citizens who lives in Islamic states, which suits for every situations and every decade.

But, to make it clear, Malaysia does not apply this law. In facts, there's a lot of differences between qisas and our current law. For instance, just one example;
1. According to current law, parties to the claim (the prosecution) is the government (public prosecutors), not the heirs of the victim.

All in all, I agree that her actions is to ensure that justice can be fully enforced.
By the way, if you noticed that I did mention about 'partial agree'. Well, that is because she said that she made a claim due to the loss faced by
the business operations of cosmetic companies. hmmm....

The Rationale of Article 153

Recently, we could see in the news, newspaper, etc, that many politicians had questions about the Article 153, which stated about the malay special privileges. They said that this article is not necessary as such that this article has denied the concept of equality among the races in Malaysia which has been stated in Article 8 of Federal Constitution, under part 2 of Fundamental Liberties.

In this entry, I'm not going to say about the reasons on why we should abolished this Article, in facts, I am firm with my decision that this Article should be remains.

Before that, I'm going to give a little bit clarification on the concept brought by this Article 153.
Article 153, is one of the articles in Federal Constitution that showed the concept of positive discrimination. What is positive discrimination ?

Positive discrimination according to Dictionary of Sociology, is a policies and practice which favour certain groups which have historically experienced disadvantages. Malaysia refers this concept as a positive discrimination, while for United States of America, they usually refer this concept as a affirmative action or reverse discrimination.

Generally, we could understand this concept as an unequally legal policies which favour certain group(s) which is underrepresented in significant positions in society. Actually, this concept of positive discrimination and affirmative action is the product of the concept of "equality". How ?

One of the doctrines of equality is "substantive equality". The Egalitarian together with the Socialist and the Communitarian subscribed the concept of substantive equality where persons should be placed in a similar position, even if in order to do so they are treated unequally. This doctrines of equality takes a few factors, as such as social conditioning, etc and review whether this policies would have an adverse effect on one party.

John Rawls in "A Theory of Justice", quoted;

" in order to treat all persons equally, to provide a genuine equality of opportunity, society must give more attention to those with fewer natives assets and to those born into the less favourable social positions. The idea is to redress the bias of contigencies in the direction of equality "

That is why, this doctrine of substantive equality is the basis of affirmative action and positive discrimination.

Did you know why this Article has been drafted ?

Because to protects Malay and natives, specifically, Bumiputra. I'm not going to type all that long about our history, we as Malaysians, should already know about it. In facts, we all just been informed that in 2013, History will becomes as a must pass subject besides BM. As we know that Chinese and Indian at that time (1957) were already a rich urban dwellers compared to Malay which mostly poor farmer and labourers. Despite, in the late 1970s, Bumiputra controlled only 4 percent of the economy. Can u imagine? only 4 percent ? How about another 96 percent ?


Next, according to Huang-Thio Su Mien in " Constitutional Discrimination Under the Malaysian Constitution (1964) ", the rationale behind the Article 153is to confer special privileges upon the Malays and natives of Sabah and Sarawak so that preferential treatment can be legally practiced;

1. as a method of adjusting the political balance of a heterogeneous society
2. to protect the interest of pluralistic minorities which aim to preserve their own culture, while
co-existing with the dominant class
3. to sanction a preferential treatment to a certain groups in a country which has previously
enjoyed special privileges
4. to empower s State to take ameliorative measures to advanced the status of economically,
socially and culturally depressed communities.

Last but not least, I could say that the reasons of the needs of this article can be merely similar with the reasons of the needs of the law as according to the theories of "Truism About Human Nature" as stated by HLA Hart.

1. Limited altruism
2. limited recources
3 Limited understanding and strength of will.

Just for an information, actually, according to this theory, there another two theories that lies in theories of "Altruism About Human Nature", that is human vulnerability and approximate equality.

Whatever it is, this is just my 2 cent opinion.

Arthur's Bus To The Artur's Day !


This is the view from the inside of the Artur's Bus. Such a grand bus. This bus is on its way to Sunway Lagoon in the countdown to the Arthur's Day which will be held on friday. In order to go to Sunway Lagoon, this bus will make its way through the streets of Kuala Lumpur.

By the way, to make it clear, i just love the view and its design. *see the label?* Not that drink. Thank you. ^^o

"Never Underestimate The Effectiveness of A Straight Cash Bribe"

Never underestimate the effectiveness of a straight cash bribe ~ cloud cockburn

It is effective, and so do it gives a great impact.

Recently, Indonesian supreme judge has stated that they are giving their full commitment and support regarding the death sentence in the fight against the bribery crimes in their country.

In my humble opinion, i do think that Malaysia should also put the same effort by enforce the same sentence for the bribery crimes. As according to Malaysian Anti-Corruption Commission Act , under the section 24 stated that any of the offences which has been done under the sections 16, 17, 18, 20, 21, 22 and 23; imprisonment for not more than 20 years; and
fined for not more than 5 times greater than the value of the bribe received.

Maybe some of us would say that this penalty is strict enough to reduce the bribery crimes in Malaysia, despite, the question "is it?" has been raised.

China, is one of the country that practicing the death sentence for this offence, has achieved a positive result. In facts, their citizens had showed their satisfaction in response of this penalty.

I would like to state just 2 cases that involve the bribery crimes in our country which is enough to show that the this crime was already in a critical stage. on what ground?

first, in october 3rd 2010, a magistrate jailed for 6 years and fined of RM40 000 at the session court after being found guilty on two corruptions charges in october. Now, at what stage is our courts' credibility in justice?

secondly, in october 14th 2010, 7 immigration officers who is said to be involves in human trafficking in terms of bribery, detained under the Internal Security Act (ISA). Now it is your interpretation pertaining to this issue. What say you?

when Eddy speaks in english....

hey guys..

this new entry, i would like to talk about my speaking test. nothing special actually. it is just that, what i promise, i must deliver it. :)

ok, as usual, woke up at around 5.50 am, then make a phone call. to who? i called hajar and amir to make sure that they are not going to be late for their speaking test, since that their speaking test will be at 7.30 am.

having my breakfast, with no appetite..there's not going to work even though it is a hotdog. Facebook-ing and reading a news at Malaysiakini.com is one of my compulsory activities at home. read, facebook, music..read, facebook, music..again and again until around 8.15 am. and not to forget, CSI New York before going to school at 10 am (my speaking test will be at 11 am)..nice ha. :P


ok, to be short (cuz i am lazy to type..just wants to finish it as fast as i can..)
i am in a third group, which consists of two girls, one of them is a teslian from puncak alam..the other one, i have no idea about her.... and one man, he is a mathematics teacher. :0
of course the last one is me.. ^^o
i, as a candidate A, my instruction for task one will be.."illegal racing on a public road, discuss".
The instruction for task B will be.."which of these social problems, will be the greatest threat to our society?"

alhamdulillah..i am the one who starts the discussion and also the one who made a conclusion..
ok thats it. ouh ya..my speaking test was done around 1 o'clock and i do really hope that band 4 (at least) will be mine..insyaAllah. ^^o

lalalala....

yo, what's up!

haha..actually i thought i would post about yesterday where i went to pertama kompleks and sogo for a shopping...but i'm lazy to do that..haha :D but today, i wanna tell about it..yosh!

so, let me summarise about what i did yesterday. i went to tabung haji to pay the fee at bank Islam with my mom after solat jumaat. After that straight away i went to sogo to buy jeans, tie, seluar slack, underwear, belt and...err..that's all i guess..huhu

after that, my friends arrived, those are bob, acap, razif, irwan and firdaus. after that i went to pertama (also with them la..) to buy, sport shoes and a shoes to use it to go to class, and a bit simple stuff like shampoo, soap, colgate and bla bla bla...actually i seek for a track-suit but couldn't find it so i bought it one day later (that is today, the day i post this entry).

ok, that's all..bye, i'm not in the mood to type that long...
